If you do not agree to these terms, promptly return this complete package unopened. License This Agreement is a license agreement between SKV International, Inc. (SKV) and you for the use of the enclosed computer programs and digitized photographic images (Software). You must reproduce a copyright notice adjacent to any reproduction of any of the images. Copyright notice should read: "@ Copyright, Photographer's Name, SKV." You may install the Software on only one computer; make a backup copy of the Software; transfer the software from one computer to another so long as there is no possibility of it being simulta- neously used by more than one user on more than one computer. You may transfer all your rights to the Software to another person, provided you transfer this complete package to that person, destroy all other copies of the Software you may have, and that person agrees to the terms of this Agreement. You may, except as specified below, modify, publish and/or distribute the images in any media. You may not translate, alter, reverse engineer, decompile, or disassemble the Software except as provided in this Agreement. You may not rent, transfer, lease, sublicense, time-share, lend or grant any rights in the Software. You may not remove or obscure SKV copyright or trademark notices. You may not modify the computer programs or merge all or any part of them into another program. You may not use the images to create immoral, obscene, pornographic, and/or scandalous works. You may not distribute in any form or media, any or all of the photographic images as another or as part of another image library. You may not use the images pertinent to identifiable individuals or entities in a manner that suggests their association with or endorsement of any product or service. This Software is and remains SKV's proprietary product and is protected by both U.S. copyright law and international copyright treaty Copyright provisions. Limited Warranty SKV warrants that the media enclosed herein to be free of defects in materials and workmanship under normal use and service for thirty days from date of receipt. SKV shall, at its sole discretion, either replace the defective item with a functionally equivalent unit, or refund the purchase price and terminate this Agreement. Any replacement shall be warranted for the remainder of the original warranty period. This limited warranty gives you specific legal rights. You may have others which may vary from state to state. Some states do not allow the exclusion or limitation for consequential or incidental damages, so some of the above may not apply to you. Important: Do not return any product until you have contacted SKV's Service Center and obtain a Return Merchandise Authorization (RMA) Number. You are responsible for sending the product to the Service Center. SKV shall be responsible for return shipment within the United States. Limitation of Liability SKV's entire and exclusive liability and your remedy shall be limited to replacement of defective media or documentation and shall not include or extend to any claim for or right to recover any other damages, including but not limited to, loss of profit, data, or use of the Software, or special, incidental, or consequential damages or other similar claims, even if SKV has been advised of the possibility of such damages. In no event will SKV's liability for any reason exceed the lower of the suggested list price or actual price paid for the license to use the Software, regardless of any form of the claim. SKV disclaims all other warranties, either expressed or implied, including but not limited to implied warranties of merchantability or fitness for a particular purpose. General Provisions This Agreement shall be governed by the laws of the State of California. it is the entire agreement with SKV and you and supersedes any other communications or advertising with respect to the Software. If any provision in this Agreement is found void or unenforce- able, the remainder of this Agreement shall remain valid and enforceable according to its terms. If any remedy provided is determined to have failed of its essential purpose, all limitations of liabilty and exclusions of damages set forth in the Limited Warranty shall remain in full force and effect. All rights not specifically granted in this statement are reserved by SKV. Use, duplication or disclosure of the U.S. Government of the Software shall be subject to the restricted rights applicable to commercial computer software as set forth in DFARS 252.227-7013.
